Fixed Costs
The Civil Justice Council's predictable costs working party is nudging
it's way towards proposed fixed or predictable costs for cases which
settle without proceedings being issued. The scheme would apply to road
traffic cases only.
The reported view of Patrick Allen President of The Association of
Personal Injury Lawyers is that the real confusion surrounding recent
costs litigation lies with success fees, insurance premiums and
recoverability not base costs and that Claimants' Lawyers are left with
the feeling that they are being 'rail roaded' into a Fixed Costs regime
through very limited research rushed through because of an agenda to
bring in Fixed Costs. Mr. Allen stated at it's Annual Conference that
APIL is opposed to a Fixed Costs regime except in limited circumstances.
