See Sayers and Others -v- Smith Kline Beecham Plc and Others and two associated actions [CA TRL 14th January 2002].

If in any court a Claimant discontinued his Claim against any one or more of the Defendants or it is dismissed by an Order of the Court whereby the Claimant is ordered to pay such Defendant's costs, then he will be liable for his individual costs incurred by such Defendants up to the last date of that quarter; liability for common costs and disbursements to be determined following the trial of common issues, with permission to apply if such a trial does take place. This form of Order should in future be used in multi-party actions.
